Alabama ESA laws for Birmingham renters

Alabama is one of the states that wrote its own rules for assistance animals in rented homes. Since 2018, the Alabama Assistance and Service Animal Integrity Act (Ala. Code 24-8A) has let a landlord ask for reliable documentation when your disability or your need for the animal is not obvious, and it set penalties for people who fake that need.

  • Under Ala. Code 24-8A-3, a landlord may only request documentation of a disability or a disability-related need that it cannot already see or does not already know about.
  • Whatever paperwork you hand over must be kept confidential, the statute says, in line with the federal Fair Housing Act and the Rehabilitation Act.
  • Lying about a disability, or giving false statements to get a housing letter, can bring a $500 civil penalty or a Class C misdemeanor the first time (Ala. Code 24-8A-4).
