Virginia ESA laws for Richmond renters
Virginia handles assistance animals inside its own fair housing statute, Va. Code 36-96.3:1. A housing provider may ask for reliable documentation of your disability and your disability-related need for the animal, unless both are already obvious or known. The same section rules out pet fees, pet deposits and extra rent for an assistance animal, while you stay responsible for physical damage.
- Supporting documentation can come from someone with whom you have or had a therapeutic relationship, such as a mental health service provider giving good-faith care.
- When your disability is known but the need for the animal isn't, the provider may ask only for verification of that need.
- A provider who writes fraudulent supporting documentation commits a prohibited practice under the Virginia Consumer Protection Act, per 36-96.3:1(F).
