Renting with an ESA in Charleston
Charleston is built into the hills along the Kanawha and Elk rivers, so rentals range from older homes on steep streets in the East End and South Hills to apartment complexes in flatter Kanawha City. A lot of the housing stock is decades old and owned by local landlords. Some leases still carry outright no-animal clauses. That does not end the conversation if you have a disability-related need. The city has its own Human Rights Commission, which accepts housing complaints.

West Virginia ESA laws for Charleston renters
West Virginia puts assistance animal rules right into its Fair Housing Act at W. Va. Code 16B-18-5. A housing provider can ask for documentation of your disability-related need for the animal but not your medical records, and the paperwork is enough when it shows the animal gives some kind of disability-related assistance or emotional support.
- Under 16B-18-5(10), a request can't be unreasonably denied or delayed, and it can't be made conditional on pet fees or deposits.
- A provider may say no only with credible evidence of a direct threat or substantial property damage, judged on that particular animal's actual conduct.
- A legislative rule, W. Va. Code R. 71-9, adds detail on housing discrimination against people with disabilities who use assistance animals; it took effect in February 2025.
