Delaware service dog laws
Delaware's Equal Accommodations Law, 6 Del. C. Chapter 45, defines a service animal as a dog trained to do work for a person with a physical, sensory, psychiatric, intellectual or other mental disability. Psychiatric service dogs are named outright, which lines the state up neatly with the ADA for stores, restaurants and other public places.
- 6 Del. C. 4504 requires public accommodations to admit a person training a service animal for people with disabilities when the animal is with them.
- Interfering with a service dog is a class B misdemeanor under 16 Del. C. 3056F, and injuring one is a class A misdemeanor.
- Killing a service dog is a class D felony and stealing one is a class E felony under the same section, with full restitution required.
- Delaware's barking-dog law, 16 Del. C. 3057F, exempts a service dog that is performing its duties.

Service dog housing rights in Delaware
If a landlord refuses a service dog, ask for the decision in writing, then contact the Delaware Division of Human and Civil Rights or file a complaint with HUD.
