Idaho service dog laws
Idaho Code 56-704A mirrors the ADA's approach: businesses must let a service dog in, may ask only whether it is needed for a disability and what task it performs and cannot demand certification papers. Dogs that do psychiatric work, such as grounding during a crisis, are included. Idaho also stands out for spelling out access rights for dogs still in training.
- Idaho Code 56-704B lets people with disabilities, and trainers carrying ID from a recognized service dog school, bring a marked dog-in-training into public places at no charge.
- Using an assistance animal or service dog to claim benefits meant for people with disabilities, when you have no disability, is a misdemeanor under Idaho Code 18-5811A.
- Intentionally startling, obstructing or intimidating a service dog or its handler is a misdemeanor punishable by up to six months in jail (Idaho Code 18-5811).
- Idaho Code 56-705 allows a civil suit against someone who intentionally violates these protections, with a minimum $500 in punitive damages.
