Indiana service dog laws
Indiana's service animal rules sit in Indiana Code 16-32-3 and 16-32-3.5, and they line up with the ADA: dogs or miniature horses individually trained for a disability, two permitted questions and no demand for certification. Psychiatric service dogs are covered when they perform trained tasks. The state adds a clear right of entry for trainers.
- IC 16-32-3-2 gives a trainer working with a service animal the same access to public accommodations, as long as the animal stays under control.
- Refusing entry or charging a fee because of a service animal is a Class C infraction in Indiana.
- Striking, injuring or otherwise interfering with a service animal while it is working is a Class A misdemeanor under IC 35-46-3-11.5, rising to a felony for serious harm.
- Indiana's civil rights law also bars employers from refusing to let an employee with a disability keep a service animal at work.
