Kansas service dog laws
Kansas uses the term assistance dog, which includes service dogs trained to perform tasks for a person with a disability, a category that can include a psychiatric service dog. Its rules in K.S.A. 39-1101 through 39-1113 run beside the ADA. The state is notably strict about false claims: misrepresenting your right to bring an assistance dog somewhere is a criminal offense.
- Making a false claim of access rights for an assistance dog, or faking a disability to obtain one, is a class A nonperson misdemeanor under K.S.A. 39-1112.
- K.S.A. 39-1109 lets a professional trainer from a recognized training center bring a dog into public places during active training, with no extra charge.
- K.S.A. 39-1111 describes an ID card or letter a handler may show if access is questioned; it must be returned promptly after it is checked.
- Under K.S.A. 39-1113, a dog present only for comfort, protection or personal defense is not an assistance dog.
