South Dakota service dog laws
SDCL 20-13-23.2 lets a person with a physical, visual, hearing, psychiatric or mental disability bring a specially trained service animal into hotels, restaurants and other public places. A business can't tack on a charge for the animal, though you're responsible for any damage it does. The ADA applies at the same time, so you have both layers of protection.
- Trainers may bring a service animal in training into the same places if it wears a collar and leash, harness or cape marking it as in training.
- An owner or employee who refuses lawful access to a handler or trainer commits a Class 2 misdemeanor under SDCL 20-13-23.2.
- Senate Bill 82, signed in March 2026, makes it a Class 2 misdemeanor to intentionally misrepresent an animal as a service animal to get into a public accommodation.
- SB 82 is aimed at public places, not rentals. Housing questions still run through SDCL chapter 43-32 and the federal Fair Housing Act.

Service dog housing rights in South Dakota
If a landlord refuses a service dog, ask for the decision in writing, then contact the South Dakota Division of Human Rights (Department of Labor and Regulation) or file a complaint with HUD.
