Kentucky ESA laws for Lexington renters
Kentucky regulates ESA documentation through KRS 383.085, added to its landlord-tenant law in 2018. When your need isn't obvious, a landlord can ask for documentation from a qualifying provider, and the statute is specific about who that is: a Kentucky-licensed clinician who actively practices in the state and has an ongoing therapeutic relationship with you. Recent arrivals get a narrow exception.
- Qualifying providers include licensed clinical social workers, professional counselors, APRNs, psychologists and physicians holding an unrestricted Kentucky license.
- If you recently moved to Kentucky, a letter from your provider in your former state works as long as that therapeutic relationship is ongoing.
- A provider whose main service is writing letters for a fee doesn't qualify, and supplying documentation mainly for a fee is itself an offense.
