North Carolina ESA laws for Charlotte renters

In North Carolina, ESA requests run through the State Fair Housing Act, Chapter 41A of the General Statutes, which tracks the federal law closely. Section 41A-4 makes it unlawful to refuse a reasonable change in rules or policies that a person with a disability needs to use and enjoy a home, and waiving a no-pets rule is a classic example. The state has no separate ESA statute.

  • Under G.S. 41A-7, a complaint has to be filed within one year of the discriminatory practice, and staff will help you put it in writing.
  • The Housing Discrimination Section of the Office of Administrative Hearings now enforces the State Fair Housing Act and takes complaints by email.
  • The tenancy right in G.S. 168-4.2 belongs to trained service animals, not emotional support animals, so an ESA depends on the fair housing route instead.
