Renting with an ESA in Winston-Salem
Old tobacco and textile wealth left Winston-Salem with large historic homes in West End and Ardmore, many now divided into apartments. Wake Forest students rent near Reynolda Road, and downtown's former factory buildings have become lofts with amenity packages. The city's Human Relations Department processes housing discrimination complaints within city limits under a local fair housing ordinance, and it also offers landlord-tenant mediation. If an ESA request turns into a standoff, mediation through that office is often faster than a formal complaint.

North Carolina ESA laws for Winston-Salem renters
In North Carolina, ESA requests run through the State Fair Housing Act, Chapter 41A of the General Statutes, which tracks the federal law closely. Section 41A-4 makes it unlawful to refuse a reasonable change in rules or policies that a person with a disability needs to use and enjoy a home, and waiving a no-pets rule is a classic example. The state has no separate ESA statute.
- Under G.S. 41A-7, a complaint has to be filed within one year of the discriminatory practice, and staff will help you put it in writing.
- The Housing Discrimination Section of the Office of Administrative Hearings now enforces the State Fair Housing Act and takes complaints by email.
- The tenancy right in G.S. 168-4.2 belongs to trained service animals, not emotional support animals, so an ESA depends on the fair housing route instead.
